Liability Waiver

Effective Date: July 26, 2025

1. Acknowledgment and Assumption of Risk

By clicking “I Agree” below, you acknowledge and agree that your use of the facilities, equipment, and services provided by Sim Cup Golf involves inherent risks, including, but not limited to, injury, property damage, or loss. You voluntarily assume all risks, whether foreseeable or not, associated with your use of the golf simulators, equipment, and any related activities conducted on the premises.

3. Waiver and Release of Liability

4. In consideration of being granted access to the facility, you hereby release, waive, and discharge Sim Cup Golf, its owners, employees, agents, contractors, and representatives from any and all liability, claims, demands, actions, or causes of action arising from or related to your use of the golf simulator facility and equipment, including but not limited to any injury, loss, or damage incurred by you.

5. This release applies to liability caused by the negligence of Sim Cup Golf or its representatives to the fullest extent allowed by law.

6. Use of Facility and Equipment

7. You agree to use the golf simulator equipment in accordance with all posted guidelines, rules, and instructions provided by Sim Cup Golf staff. You accept full responsibility for any damage to the facility or equipment caused by your misuse, negligence, or failure to follow instructions.

8. Medical Conditions and Emergency Care

9. You confirm that you are in good health and physically capable of participating in golf simulator activities. You acknowledge that Sim Cup Golf does not provide medical personnel or treatment on-site. In the event of a medical emergency, you authorize Sim Cup Golf to seek medical attention on your behalf, and you assume all costs associated with such care.

10. Minors

11. If agreeing on behalf of a minor, you affirm that you are the minor’s parent or legal guardian and accept full responsibility for the minor’s participation, including the risks and liabilities outlined in this agreement.

12. Indemnification

13. You agree to indemnify and hold harmless Sim Cup Golf, its owners, employees, agents, contractors, and representatives from any claims, damages, or costs arising from your actions, conduct, or negligence during your use of the facility and equipment.

14. Photography and Media Release (Optional)

15. By clicking “I Agree,” you consent to Sim Cup Golf using photographs or video recordings of you taken during your use of the facility for marketing and promotional purposes, without compensation. [You may opt out of this clause by contacting us directly.]

16. Governing Law

17. This waiver shall be governed by the laws of the State of Florida, and any legal disputes arising from this agreement shall be resolved in the courts of Brevard County, Florida.

By clicking “I Agree,” you confirm that you have read, understood, and agreed to the terms of this Waiver of Liability. If agreeing on behalf of a minor, you confirm that you are the parent or legal guardian and accept all responsibilities outlined herein.

Please note: You must agree to the terms above to use the golf simulator facilities provided by Sim Cup Golf.
